One of the most challenging issues in today's society is the permission or non-permission of the Islamic government to impose the hijab, about which the proponents and the opponents have spoken a lot. However, it seems that reducing the issue of hijab to criminal jurisprudence is not appropriate, but the issue should be raised more comprehensively, and that is the position of Islamic criminal policy on the issue of hijab, so that the limits of authority and duty of the government and The Islamic society should be clarified on the issue of hijab. This research has studied this issue in a descriptive-analytical method using Islamic sources and jurisprudential texts and has concluded that Islamic criminal policy in three levels of social, status and criminal prevention has paid attention to the issue of hijab and members of society and civil society organizations. The Islamic government has duties to explain, promote and institutionalize the Islamic hijab in society, and the Islamic government at the level of criminal prevention has the right to criminalize non-observance of the Islamic hijab under conditions that are in the interest of the individual and society.
