Significance of Personality Dossier for Female Accused and Convicted Individuals in the Iranian Legal System

Abstract
Opening personality dossiers is crucial for ensuring proportionality between crime and punishment, as well as for applying the principle of punishment individualization. This approach helps tailor corrective, educational, and curative methods to the criminal’s personality. However, the lack of policies addressing the various dimensions of female accused individuals diminishes the effectiveness of personality dossier openings, particularly for women, and undermines their access to criminal justice. Using a descriptive-analytic method and bibliographical data collection, this research explores the significance of opening personality dossiers for female accused and convicted individuals within the Iranian legal system. The findings suggest that incorporating personality dossier openings for women may be necessary within the Islamic legal framework. For example, Islam differentiates punishments for female and male criminals, acknowledges the differences in the nature of crimes committed by women and men, and considers specific factors contributing to women’s criminal behavior.
