Elucidating the Jurisprudential Ruling on the Husband's Liability for the Wife's Medical Expenses with an Emphasis on the Objectives of Sharīʿah in the Family System

Abstract
Islamic Sharīʿah has imposed certain duties upon the husband in order to fulfill the financial needs of the wife. Corresponding to these duties, certain rights have also been established for the wife, among the most significant of which is maintenance (nafaqah). Employing an exploratory-analytical method and utilizing library-based sources, this study seeks to address the following question: What is the husband's responsibility with respect to the wife's medical expenses? In order to arrive at an answer, the pertinent evidence concerning the legal framework of women's rights has been examined in light of the position of the family within Islamic teachings. The finding of this research is that, for the following reasons, the husband is obligatorily liable for the full payment of medical expenses for all types of illnesses afflicting the wife:
the general purport of the evidence enjoining good conduct (al-muʿāsharah bil-maʿrūf); the husband's role as qawwām (protector and maintainer); the general principles prohibiting the imposition of hardship upon the wife; the exigencies of the husband's responsibilities toward his dependents; traditions (riwāyāt) indicating non-exclusivity; the applicability of the customary standard (ʿurf) to medical expenses; reasoning a fortiori (qiyās al-awlā); and the established practice of the religious community (sīrat al-mutasharriʿah). All of these are premised upon the articulation of a new conception of maintenance (nafaqah) grounded in the genuine needs of the wife and the financial capability of the husband.
